Terms of Service

1. Acceptance of Terms

By accessing or using the ImgShare image hosting service at www.img-sharing.com (the "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, you must not use the Service.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date above and may post a notice on the website. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

2. Description of the Service

ImgShare provides a free, web-based image hosting platform that allows users to:

• Upload image files (JPEG, PNG, GIF, WebP) up to 5 MB each
• Receive a unique, shareable short URL for each uploaded image
• Obtain direct image links, HTML embed snippets, Markdown syntax, and BBCode for embedding on external platforms
• View uploaded images through a web-based image viewer
• Use supplementary tools including an AI-powered background remover and a meme text overlay generator

The Service is provided on an anonymous-upload basis — no user account is required to upload or share images. We may introduce optional registered accounts with additional management features in the future, at which point supplementary terms may apply.

3. Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the Service. By uploading content or otherwise using the Service, you represent and warrant that you meet this age requirement. If we learn that a user under the applicable minimum age has used the Service, we will terminate their access and delete any associated content.

4. User Conduct and Responsibilities

By using the Service, you agree to the following obligations:

• •Ownership and authorization — You will only upload images that you own, have created, or have explicit permission to share. Uploading copyrighted content without authorization is a violation of these Terms and may expose you to legal liability.
• •Lawful use — You will not use the Service for any purpose that violates applicable local, national, or international laws or regulations.
• •No abuse of infrastructure — You will not use automated scripts, bots, or other tools to upload images at a rate that exceeds reasonable personal or small-business use, unless you have obtained prior written permission or are using our documented API within its published rate limits.
• •No circumvention — You will not attempt to bypass technical measures we implement, including file size limits, rate limits, content filters, or access restrictions.
• •No harmful use — You will not use the Service to host images that are part of phishing campaigns, scam operations, spam distribution, malware delivery, or any scheme designed to deceive or harm others.

5. Prohibited Content

The following categories of content are strictly prohibited and will be removed immediately upon detection or report:

We employ automated content classification (machine learning-based NSFW detection) and respond to user reports. Violations may result in immediate content removal, IP-based access restrictions, and reporting to law enforcement where legally required or warranted by the severity of the violation.

6. Intellectual Property Rights

6.1 Your Content

You retain full ownership of the images you upload. By uploading content to ImgShare, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, cache, reproduce, and distribute your content solely as necessary to operate and provide the Service. This includes caching on CDN edge servers, generating thumbnails for the viewer page, and serving the image to anyone who accesses the shareable link.

This license terminates when your content is deleted from the Service, except for copies that may temporarily remain in CDN caches or backup systems (which are purged within 90 days of deletion).

6.2 Our Intellectual Property

The ImgShare name, logo, website design, source code, and all related visual and textual elements are the intellectual property of ImgShare. You may not reproduce, modify, distribute, or create derivative works based on our branding or platform design without prior written consent. This restriction does not limit your ability to link to the Service or embed images hosted on the Service.

7. Copyright Infringement and DMCA

We respect intellectual property rights and respond to valid copyright infringement notices under the Digital Millennium Copyright Act (DMCA) and equivalent international frameworks. If you believe that content hosted on ImgShare infringes your copyright, you may submit a takedown notice to our designated agent.

What to Include in a DMCA Notice

Your notice must contain all of the following:

1. A description of the copyrighted work you claim has been infringed
2. The specific ImgShare URL(s) of the allegedly infringing content
3. Your full legal name, mailing address, and email address
4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
6. Your physical or electronic signature

Upon receiving a valid DMCA notice, we will remove or disable access to the allegedly infringing content promptly and, where possible, notify the uploader. Repeat infringers may be permanently blocked from using the Service.

8. Service Limitations and Fair Use

To ensure consistent service quality for all users, the following limitations apply:

We reserve the right to adjust these limits at any time to maintain service stability. If you require higher limits for a specific use case (such as integrating ImgShare into a product or service), contact us at hello@img-sharing.com to discuss options.

Additionally, we reserve the right to throttle or temporarily restrict access from individual IP addresses that exhibit usage patterns consistent with abuse — such as automated mass uploads, scraping, or deliberate bandwidth exhaustion.

9. AI-Powered Tools

ImgShare offers supplementary AI-powered tools — currently a background removal tool and a meme generator — as part of the Service. These tools process your images on our servers using machine learning models.

• •Images submitted to AI tools are processed in memory and are not retained after the output is generated, except when the output is saved as a new hosted image (in which case the output image is subject to the same hosting terms as any other upload).
• •We do not use images submitted to AI tools to train or fine-tune our models.
• •AI tool outputs are provided on a best-effort basis. Results may vary in quality depending on the complexity of the input image, and we do not guarantee pixel-perfect accuracy.

10. Advertising

ImgShare is a free service sustained by advertising revenue. By using the Service, you acknowledge that advertisements (including those served by Google AdSense) will be displayed on pages within the Service. We strive to keep ads non-intrusive and clearly distinguishable from site content.

We do not control the specific advertisements shown to you by third-party ad networks. If you encounter an ad that you believe is inappropriate, misleading, or malicious, please report it to us at hello@img-sharing.com so we can investigate and, if necessary, block the ad source.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE THE PERMANENCE OF ANY UPLOADED CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMGSHARE AND ITS OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless ImgShare and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) content you upload, (c) your violation of these Terms, or (d) your violation of any third-party rights, including intellectual property rights.

14. Termination and Suspension

We may terminate or suspend your access to the Service at any time, without prior notice, if we reasonably believe that you have violated these Terms. Specifically:

• Uploading prohibited content will result in immediate content removal and may result in an IP-level access block
• Repeated violations or severe single violations (such as CSAM) will result in permanent access restriction and reporting to authorities
• Abuse of infrastructure (e.g., mass automated uploads) will result in rate limiting or temporary suspension

We may also discontinue the Service entirely at any time, with reasonable notice where practicable. In such an event, we will make reasonable efforts to allow users to retrieve their content before shutdown.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea.

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at legal@img-sharing.com. We will make a good-faith effort to resolve the issue within 30 days.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ImgShare regarding your use of the Service. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
